Revenge Porn is referred to as image-based, sexual abuse. This is a serious criminal offence under the Harmful Digital Communications Act. It is illegal to share, publish, or threaten to share intimate, sexual photos or videos of someone without their explicit ongoing permission. The law states this is a harmful to share intimate, visual recordings without consent is an offence.

There Is No Intent Required Here

You no longer need to prove that the perpetrator specifically intended to cause harm of distress to the victim. The simple act of distributing or publishing the image without consent is enough for prosecution.

Penalties

Anyone convicted of this offence can face up to two years in prison or a fine of up to $ 50.000 with intent to cause harm or serious emotional distress.

Digital Forgeries

The law extends to cover Al generated or “Deep Fake” imagery to explicitly including images that are digitally created or altered without consent.

Revenge Porn, also called non-consensual pornography (ALCP) or image- based sexual abuse, is the act of sharing intimate, nude, or sexual photos, or videos of someone without their explicit consent, usually, with the intent to humiliate, harass or seek revenge.

How It Happens

The imagery are typically shared online via social media, websites, or messaging apps, but can also be distributed via email, text, or by showing them, in person.

How Images Are Obtained

Perpetrates may use photos of originally shared privately between partners (via sexting) secretly recording someone without their knowledge, or hacked into the victims device or cloud accounts.

The Motivation

While often perpetrated by an ex-partner to caused distress follows a break- up, it can also be done by acquaintances, strangers, cyber attackers.

Legal Status

This is a crime in most countries to show revenge porn. It is a serious criminal offence. Punishable by hefty fines or imprisonment. The harm it causes severe emotional distress, reputations, damages and psychological harm, and is widely classified as a form of sexual abuse and digital harassment with the punitive intention to create public harm. You re not obligated to engage in any sexual activity it is non- consensual distribution of intimate images. It is image based abuse that is shared or threatened to share without content.
